It's jurisdiction is to try individuals "responsible for serious violations of international humanitarian law committed in the territory of the former Yugoslavia since 1991." With this strict purpose, the ICTY issued 161 indictments for persons believed to be responsible for such "serious violations." <br /><br />Up until this May, two indictees, Mladic and Hadzic were at large and living in hiding as fugitives. After Mladic was arrested in May, this left Goran Hadzic as the last indicted person still at large. Now that Hadzic has been found in Serbia and transferred to the ICTY, the Court now will conduct official proceedings as it has for the previous 160 indicted persons. <br /><br />The ICTY has concurrent jurisdiction with the national governments of the former Yugoslavia. The ICTY's mandated jurisdiction is to try those persons responsible for "serious" violations of international humanitarian law or as Professor Dunlap said during the IHRC teleconference, "the big fish" offenders. The ICTY indicted 161 persons or "big fish" and proceedings for those 160 have concluded or are currently underway. Other offenders have been tried in national courts. <br /><br />Hadzic is the last of those indicted by the ICTY to meet the judicial process. He was indicted in 2004 and since lived as a fugitive.<br /><br />Since the ICTY has limited jurisdiction tied to the territory of the former Yugoslavia and temporally constrained to crimes committed since 1991, the ICTY is not mandated to exist indefinitely into the future. An outspoken group of independent black farmers is accusing many of the most visible activists in the black farm movement and in Congress, of self-promotion, obstruction and gamesmanship.<br /><br />They say it's not about the money. It's about millions of acres of black-owned land that have been illegally sold, with another million at risk of being stolen through illegal foreclosure and sold. And, it's about activists and self-proclaimed leaders who promote their own personal agendas at the expense of the people they purport to represent. With that in mind, insiders say a group of black farmers is preparing to take their case before the World Court. They say if the United States can take Zimbabwe to task for its farm and land policies and haul the nation before the Court, what's good for the goose is good for the gander.<br /><br />Farm rights activist Eddie Slaughter believes it is time to take the black farmers' situation to another level. He and others believe that the "leadership" of the black farmers' movement, along with elements in Congress, are not as pro-human rights as they claim to be. The report documents how the Congolese Army (FARDC) has been committing serious human rights abuses that amount to war crimes in East Congo and calls on the UN Security Council to demand the Congolese Government to immediatly investigate and hold accountable soldiers responsible for war crimes.<br /><br />The MJPC is gravely concerned at continuing reports of sexual violence in eastern Congo. The Clingendael was the former HQ of the Nazis when they occupied Holland and people were tortured there. Now, it is a beautiful location within grounds filled with trees, lawns, ponds, and numerous geese as well as stately buildings. Justice Richard Goldstone, former chief prosecutor of the ICTY, spoke in an interview format and gave many useful reflections. He dreams that there will someday be no need for ad hoc tribunals like the Int'l Criminal Tribune for the former Yugoslavia, the Int'l Criminal Tribune for Rwanda, and others b/c there will be a single court, such as the Int'l Criminal Court, that has jurisdiction over all crimes of this nature. He noted that the ICC would not exist were it not for the U.S.'s early support for the concept of the ICC in the 1990s as well as the U.S. support for the predecessor tribunals, such as ICTY and ICTR, that set the stage for the ICC. Justice Goldstone noted that tribunals serve a few different functions (he had been asked to explain to the younger members of the audience from high school why tribunals were important), including (a) helping the victims with their healing process; (b) bringing accountability, and (c) establishing the truth so that national myths (e.g. we were all victimized by another party) could not persist (e.g., instead, in the Balkans, e.g., he noted that Serbs, Croatians, and Bosnians were both victims and aggressors to each other). Justice Goldstone is currently serving a three month fellowship in the Hague sponsored by Leiden University and NIAS (Netherlands Institute of Advanced Studies?). It was very interesting to hear about the role of these historical tribunals straight from the former chief prosecutor of ICTY. Justice Goldstone is now preparing a report on Gaza on behalf of the UN. I believe he might be a special rapporteur but I have to research the inquiry further. Laurent Nkunda, former leader of the National Congress for the Defence of the People (CNDP) armed group, was arrested on 22 January and is detained at an undisclosed location in Rwanda.<br /><br />How long would it take for the chief prosecutor of the International Criminal Court (ICC), Luis Moreno-Ocampo to decide whether or not to issue an arrest warrant against Nkunda? echoed Makuba Sekombo, Director of Community Affairs of MJPC. Human Rights Watch, for example, which has been calling for his arrest for war crimes and crimes against humanity since February 2006 and has documented summary executions, torture and rape committed by soldiers under the command of Nkunda in Bukavu in 2004 and in Kisangani in 2002. Also armed groups loyal to warlord Nkunda have been repeatedly accused of using rape as a weapon of war and the recruitment of child soldiers, some as young as 12 after the abduction from their homes. In November 2008, the UN mission in the country (MONUC), Humn Rights Watch many other organizations accused Nkunda of war crimes in November 2008; an estimated 150 people were killed innoncently in the town of Kiwanja by the troups loyal to Nkunda.<br /><br />The MJPC deplores the refusal by the Government of Rwanda to hand over Nkunda for trial. “How shocking that Rwanda which has been receiving assistance from the International community to arrest genocide suspects and hand them over to the ICTR or to Rwanda would not allow for the extradition of a war criminal accused of massacring civilians, sexual violence, abduction of civilians, including children forcibly recruited as fighters and then used to attack civilian communities” said Mr. Sekombo.<br /><br />“While Nkunda is not the only one who committed war crimes and crimes against humanity, the ICC arrest warrant would mark a major step in promoting accountability for war crimes and crimes against humanity committed in DRC, added Sekombo. In point of fact, much like other 'Islamophobia' hysterics, the initial reaction proved to be not only overstated, but completely erroneous, not to mention completely lacking in any sense of journalistic ethics - such as basic regard for truth. From what I understand, only those who are actively in the military and their spouses/dependents (including parents if they supply over 50% of their support) are covered by SOFA. Also, as far as “serious and premeditated felonies”, those tend to cover theft, rape, murder (including vehicular manslaughter). However, a lot of it depends on whether or not the suspected result is going to be the death penalty or, as is the case in some countries, permanent disfigurement (such as chopping off your hands for stealing stuff). Also understand that after the country has released him back to the military, the member is then tried under the UCMJ and will most likely get sentenced again, or even get sentenced even after they have been acquitted by the host country.Anonymousnoreply@blogger.com
