<b> Introduction:</b><br />

Holocaust survivors and their heirs must exhaust their local remedies in Hungarian courts before they can pursue claims against the Hungarian railway in U.S. federal courts, according to a recent decision from the U.S. Court of Appeals for the Seventh Circuit. But, the Seventh Circuit also indicated that if their attempts to pursue remedies are unreasonably or arbitrarily frustrated in Hungary, U.S. federal courts might be able to adjudicate their claims under the Alien Tort Statute and pursuant to exceptions to the Foreign Sovereign Immunities Act.<br />
<br />
<b> Facts and Claims:</b><br />
<br />
<i> Fisher v. Mahyar Allamvasutak Zrt</i>, 777 F.3d 847 (7th Cir. 2015), arose from the persecution of Jews in Hungary during the Holocaust. In their complaint, the survivors and heirs set forth various claims against the Hungarian State Railways (“MAV”), alleging that in 1944, during the final six months of the war, MAV was a key player in Hitler’s “Final Solution” and transported Hungarian Jews to Auschwitz and other death camps. The survivors also alleged that MAV, as an agent of the Hungarian government, looted and plundered Jewish possessions brought to the train stations in their suitcases, expropriated land and property in buildings left behind, and even forced the survivors to either directly or indirectly pay for their trips to the death camps. Each of the twenty-one plaintiffs claim that they were either personally deported by MAV in 1944 or are the heirs or next of kin to victims of the Hungarian Holocaust. The plaintiffs allege the complicity of MAV for the use of its trains in connection with the transportation of approximately 500,000 Hungarian Jews to the death camps, that Hungarian laws authorized the confiscation of private bank accounts belonging to its Jewish citizens, and that MAV personnel (acting as representatives of the Hungarian government) stripped the deportation train passengers of their personal property such as cash, jewelry, family heirlooms, gold, and antiques.<br />

Plaintiffs contend that they were never compensated for MAV’s taking of property in violation of international law, that MAV conspired to commit genocide in violation of international law, and that MAV was unjustly enriched by looting assets of the Jews it transported on its trains to the death camps. The plaintiffs also seek an accounting and declaratory relief from the courts. The plaintiffs alleged jurisdiction under the Foreign Sovereign Immunities Act, 28 U.S.C. §§ l330, l332(a), l39l(f) and l60l-l6ll (“FSIA”), the Alien Tort Statute, 28 U.S.C. § 1350 (“ATS”), class action diversity jurisdiction, and federal question jurisdiction. This case is the second of a pair of cases brought by the same group of plaintiffs concerning actions of the Hungarian government during World War II. The first case was brought against Hungarian banks and was subject of a previous Seventh Circuit opinion. (<i>Abelesz v. Nemzeti Bank</i>, 692 F.3d 661 (7th Cir. 2012)). In that case, the Seventh Circuit held that the national railway and the bank were instrumentalities of the Hungarian government and could only be sued in the United States if the plaintiffs showed that they had exhausted all domestic remedies available in Hungarian courts. Although the Seventh Circuit affirms the District Court’s dismissal of the plaintiffs’ claims for failure to exhaust remedies in Hungary, the dismissals are without prejudice, allowing plaintiffs to refile their claims after they have pursued and exhausted remedies available in Hungarian courts.<br />
<br />
<b> Applicable Law:</b><br />
<br />
In addition to discussing general principles of international law such as property confiscation, sovereignty, and genocide, the court’s opinion focuses particularly on two U.S. statutes: the ATS and the FSIA. The ATS was passed as part of the Judiciary Act of 1789, and states that “[t]he district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the law of nations or a treaty of the United States.” The Foreign Sovereign Immunities Act of 1976 provides the exclusive basis for exercising jurisdiction over a foreign sovereign or instrumentalities of a foreign sovereign in the United States. The FSIA bars jurisdiction in U.S. federal courts “against foreign sovereigns for claims for death or personal injury or damage to or loss of property that does not occur in the United States,” but does allow “jurisdiction over foreign sovereigns for claims for takings of property in violation of international law.”<br />
<br />
<b> The Opinion:</b><br />
<br />
In its opinion, the Court briefly discusses the prior appeal in the <i>Abelesz</i> matter as it relates to the general rule of sovereign immunity, the default position that is pro-immunity, and the applicable exceptions that are pertinent in the <i>Fischer </i>matter. Importantly, while Hungary does recognize international law norms in its constitution, it did not waive its sovereign immunity for these claims. Under §1605 of the FSIA, the only other relevant exception to sovereign immunity is the expropriation exception. The Court plainly states the conditions where the expropriation exception applies. It occurs “where (1) rights in property are in issue; (2) the property was taken; (3) the taking was in violation of international law; and (4) at least one of the two nexus requirements is satisfied.” The Court also restated its holding in <i>Abelesz</i> that even though the FSIA does not specifically obligate the parties to exhaust domestic remedies, because §1605 “rel[ies] on international law norms . . . plaintiffs would need to exhaust domestic remedies before they could assert a violation of customary international law in a United States court.” <i>Fischer</i>, 777 F.3d at 854. The Court’s position is consistent with the policy of federal judges to be sensitive not only to universal doctrines of international law, but foreign policy considerations and comity concerns.<br />
<br />
In light of the Court’s holding in <i>Abelesz</i>, Plaintiffs in the <i>Fischer</i> matter tailored their case to focus on the expropriation of property and money by the Hungarian railway MAV and the Hungarian national bank. Defendants moved to dismiss asserting that Plaintiff had not met the exhaustion requirement. The District Court agreed and entered a dismissal order.<br />
<br />
Plaintiffs appealed, arguing that exhaustion of Hungarian remedies was not legally required and, even if they were, exhaustion would be fruitless because of the current anti-Semitic political situation in Hungary. Defendants argued that “because a sovereign could expropriate the property of its own nationals within its own territory without violating international law,” the confiscation of property during the Holocaust was not a violation of international law and are therefore not justiciable under the FSIA. <i>Id.</i> at 854. The Seventh Circuit takes each of the Plaintiffs’ assertions in turn. First, Plaintiffs argue that they have sufficiently alleged discriminatory takings as that term is defined in the Restatement Third of Foreign Relations Law §712 and therefore should not be held to an exhaustion requirement. The Court clarifies that there are actually two forms of exhaustion that occur in international law. The first is where a plaintiff would be required to exhaust domestic remedies before it can even put forth an allegation that an international law has been violated. The second form, at issue in this case, is when there is already a purported violation of international law, but international law customs limit plaintiff’s ability to bring a claim outside of the domestic forum until plaintiff has exhausted available remedies in its home country. The <i>Fischer</i> plaintiffs alleged “violations of international law due to the genocidal nature of the expropriations”. Under the Court’s holding in the <i>Abelesz</i> case, they were therefore required to seek remedies in Hungary before pursuing their claims in the American federal court system.<br />
<br />
Plaintiffs argued that they did not bother to pursue remedies in Hungary because there is a legally compelling reason for them to be excused from this rule –the Hungarian courts would not provide them with an unprejudiced and fair hearing. Plaintiffs provided three reasons for its position. First, because Defendants denied the allegations in the Complaint, Hungary was essentially denying any responsibility for its actions during the Holocaust. Next, Plaintiffs argued that the remedies available in Hungary were an inadequate mechanism for redress. Finally, they argued that the Hungarian courts were structurally insufficient to hear and rule on these claims.<br />
<br />
Defendants countered by identifying various remedies that might be available to the Plaintiffs in Hungarian courts, including non-judicial remedies such as through the First, Second, and Third Compensation Acts and the Jewish Heritage Public Foundation. The District Court found that these recoveries were not truly available to Plaintiffs. Yet, the Seventh Circuit decided that the Plaintiffs had the ability to bring civil actions for property-based, contractual, and international law claims in Hungarian courts and that such suits were promising enough that Plaintiffs should have pursued claims there before filing their action in the United States. The Court acknowledged that the significant changes to the Hungarian judicial system since 2012 could bring into question the independence of the judiciary there, but it considered concerns about judicial independence too speculative to supersede the need for the exhaustion requirement. Interestingly, the Court considered the situation of the Jewish Plaintiffs in these cases as analogous to the cases brought in U.S. courts on behalf of African-Americans during the Civil Rights Movement observing that:<br />

Yet our courts by and large rose to the challenge in the following decades.</span></span></blockquote>

<i> Fischer</i>, 777 F.3d at 865. The Court simply states that Plaintiffs have not presented compelling reasons for failing to exhaust remedies in Hungary, but repeats that this failure can be cured; if Plaintiffs’ attempts in Hungary are arbitrarily or discriminately barred, U.S. district courts could again be open to hear their claims.<br />
<b><br />
Conclusion:</b><br />
<br />
It is evident that in 1945 the Plaintiffs would have gotten a prejudiced and unfair day in a Hungarian court. The present political landscape, although not completely void of bias, is different today. For comity reasons, U.S. courts cannot – and will not – outright reject principles of exhaustion that are embedded in customary international law. International and human rights attorneys who have clients or potential clients should consider bringing lawsuits in the U.S. district courts for just compensation relief for property takings as defined under international law, with the important caveat that all adequate remedies available in the victims’ home countries must be first exhausted. As Judge Hamilton states, “while the doors of United States courts are closed to these claims for now, they are not locked forever.” <i></i> at 852. The willingness of the Court to keep the doors open to these Plaintiffs seem to signal that while the United States is not the proper jurisdiction for every international law violation, it stands ready to make itself available all domestic remedies have been properly pursued and exhausted.<br />

OWAAT is a sustainable, community-court collaboration to prevent all forms of non-physical, non-violent abuse against women, as unwanted contact interference in violation of their international human right to privacy. <br />

OWAAT was initially launched between August 2014 to May 2015, in Cyprus by a U.S. Fulbright Scholarship grant to <a href="https://www.linkedin.com/in/patricia-m-martin-attorney-at-law-p-c-2a495866" target="_blank">Patricia M. Martin</a>, a Denver Colorado attorney who modeled her project after Denver’s County Courthouse “<a href="http://psghelps.org/" target="_blank">Project Safeguard</a>” and <a href="http://www.coloradolawyerscommittee.org/projects/current-volunteer-opportunities/legal-night-for-volunteers" target="_blank">Denver Legal Nights</a>. Today, Ms. Martin continues to help guide OWAAT volunteers in Cyprus to achieve its aims also encouraged and supported by the President of the Supreme Court of Cyprus, a newly elected Justice of the European Court of Human Rights from Cyprus, President of Family Courts in Nicosia and the President of Family Court in Larnaca. <br />

OWAAT aims at empowering women to first know what human rights they have and then be guided to self-help as self-represented civil litigants seeking immediate civil protections court orders for no contact to end their own abuse. </span></span><br />

<span style="color: black; font-family: "georgia" , serif;"><span style="font-size: medium;"><i>We, the undersigned lawyers and jurists, write to express our deep concern about the scores of lawyers detained or intimidated in China. The crackdown began on the night of 9 July 2015 with the detention of lawyer Wang Yu, her husband and their 16-year-old child in Beijing. Since then, hundreds of lawyers, law firm staff and family members have been subject to intimidation, interrogation, detention as criminal suspects, and forced disappearance.<br />
<br />
Twelve lawyers and legal assistants remain under criminal detention or arrest. Most of those under arrest are suspected of “subversion of state power” or “inciting subversion of state power”. None of them have so far been allowed access to counsel, friends or family, and they are effectively disappeared. In some cases there is good reason to fear that they were put under pressure to “dismiss” their previously appointed lawyers. Some are not known to be suspected of any crime at all; and in the additional case of lawyer Li Heping, the Chinese government has so far declined to admit that he is being held at all.<br />
<br />
We fear that without legal representation of their own free choice or other legal protections, the persons above are at high risk of torture or other cruel and inhuman treatment. Our concern is heightened by the findings of the UN Committee Against Torture, which stated on 9 December 2015 that it “remains seriously concerned over consistent reports indicating that the practice of torture and ill-treatment is still deeply entrenched in the criminal justice system, which overly relies on confessions as the basis for convictions”.<br />
<br />
Moreover, the state-controlled Chinese media have in a series of broadcasts denounced a number of detained “suspects” as members of a crime syndicate engaging in “rights-defence-style troublemaking”, and paraded some of those detained “confessing” to wrongdoing before they have even been publicly indicted.<br />
<br />
In order to vindicate its claim to be a responsible stakeholder in the international community and to be a respected global superpower, it is imperative that China honour its international commitments. Therefore, we respectfully urge President Xi Jinping to:<br />

</span></span> <span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">Sixty-nine journalists were killed around the world on the job in 2015. Twenty-eight of them were slain by Islamic militant groups, including al-Qaeda and ISIS, according to the Committee to Protect Journalists.<br />
<br />
The New York-based organization says Syria again was the deadliest place for journalists, though the number of deaths there in 2015 — 13 — was lower than in previous years of the conflict.<br />
<br />
“These journalists are the most vulnerable,” Joel Simon, the committee’s executive director said of reporters and broadcasters working in Syria and other areas inundated with Islamic extremists. “This is, clearly based on the data, an incredible risk for journalists.”<br />
<br />
Those killed by Islamic extremist groups this year included eight journalists killed in an attack in Paris in January at the office of satirical magazine Charlie Hebdo, which had published caricatures of the Prophet Muhammad. The group al-Qaeda in the Arabian Peninsula claimed responsibility for the attack in which two gunmen massacred 12 people. They said it was in “revenge for the prophet.”<br />

In October, two Syrian journalists, Fares Hamadi and Ibrahim Abd al-Qader were killed by ISIS militants.<br />
<br />
While some of the deaths were among reporters covering conflict zones, journalists in several countries also were killed after reporting on sensitive subjects. At least 28 of the reporters who were killed had received threats before their deaths, the Committee to Protect Journalists said.<br />
<br />
In Brazil, Gleydson Carvalho, a radio broadcaster who often criticized local police and politicians for purported wrongdoing, was shot and killed while presenting his afternoon radio show in August. The committee tracked six killings in Brazil this year — the highest it has recorded there.<br />
<br />
Among the 69 journalists killed were reporter Alison Parker and videojournalist Adam Ward, of Roanoke, Virginia, TV station WDBJ, who were fatally shot in August by former co-worker Vester Lee Flanagan II during a live broadcast. Their interview subject, Vicki Gardner, was wounded. Flanagan fatally shot himself five hours later after a police chase.<br />

“Journalists are a target and this just confirms it,” Simon said of the data the committee compiled. “This is a global threat.”<br />

An estimated 240,000 Syrian, including 12,000 children, have been killed since the outbreak of civil war in March 2011. Over 1 million have been wounded or permanently disabled. More than 400,000 Syrians have risked their lives this year to travel to Europe, but under 150,000 Syrians have declared asylum in the European Union. </span></span> <span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">A personal apology from the president appears to have done little to appease Médecins Sans Frontières (MSF - also known as Doctors Without Borders), which continues to call for an independent investigation into the U.S. airstrike that hit one of its hospitals and killed 22 civilians.<br />
<br />
“We received President Obama's apology today for the attack against our trauma hospital in Afghanistan," Médecins Sans Frontières international President Dr. Joanne Liu said in a statement Wednesday night. "However, we reiterate our ask that the U.S. government consent to an independent investigation led by the International Humanitarian Fact-Finding Commission to establish what happened in Kunduz, how it happened and why it happened." Obama called Liu earlier Wednesday to offer his <a href="http://www.usnews.com/news/world/articles/2015/10/08/after-obama-apology-medical-charity-presses-probe-request" target="_blank">apology</a> for the strike, the first time the United States apologized for the incident.<br />
<br />
"When the United States makes a mistake, we own up to it, we apologize where appropriate, and we are honest about what transpired,” White House press secretary Josh Earnest said Wednesday when telling reporters about the call.<br />
<br />
Last weekend, an airstrike carried out by U.S. forces hit the hospital and killed 12 Médecins Sans Frontières staff members and 10 patients, including three children. The strike was requested by Afghan forces under fire from the Taliban. But coalition commander Gen. John Campbell has said U.S. officials <a href="http://thehill.com/policy/defense/256052-general-us-officials-signed-off-on-airstrike-that-killed-22-civilians" target="_blank">signed off </a>on it and so are ultimately responsible.<br />

Three investigations are underway by Pentagon, NATO and Afghan officials.<br />
<br />
Médecins Sans Frontières has called the incident a war crime and has demanded an independent investigation.<br />
<br />
The <a href="http://www.ihffc.org/index.asp?Language=EN&page=home" target="_blank">International Humanitarian Fact-Finding Commission</a> is a 15-person body established in 1991 by the Geneva Conventions to investigate breaches of international humanitarian law. The United States and Afghanistan would both have to consent for the commission to investigate. In addition to Liu’s statement, on Thursday, Médecins Sans Frontières General Director Christopher Stokes reiterated the charity’s call for an investigation. <br />

Médecins Sans Frontières wants the investigation “to get the facts of what happened, the truth,” Stokes told reporters in Kabul, according to The Associated Press.</span></span></div>

<br />
<b>THE BALKANS</b> - Tens of thousands of migrants and refugees are working their way north through the Balkans. Masses of migrants and refugees, many from Syria, Afghanistan and Kosovo, have been overwhelming border authorities in several Balkan countries as they try to reach Western Europe. The migrants travel in groups of just a few to dozens, moving north by bus, train, taxi or van. Serbian news media reported that some 70 buses of migrants entered the capital, Belgrade. Migrants in Macedonia told reporters that they were especially eager to move after Hungary said it planned to complete a fence along its 109-mile border with Serbia. <br />
<br />
<b> THE MIDDLE EAST</b> - Syria’s neighbors have been making it harder for migrants to cross into their territories. Years of violence in Iraq and Syria have stretched the capacities of neighboring countries to accommodate the displaced. In Jordan, unemployment has almost doubled since 2011 in areas with high concentrations of refugees, according to a recent International Labor Organization study. Lebanon began to require visas from Syrians in January. Refugees now make up about 20 percent of Lebanon’s population. In March, Turkey announced it would close the two remaining border gates with Syria. <br />
<br />
<b> SOUTHEAST ASIA</b> - Thousands of Bangladeshis and Rohingya, an ethnic minority from Myanmar, have fled from poverty and persecution. Indonesia and Malaysia, countries that in the past have quietly taken in many refugees from Bangladesh and Myanmar, first reacted to the new rise in migrants by vowing to send back smugglers’ boats. Facing public pressure, they reversed their stance in mid-May, saying they would provide shelter to migrants still at sea. An absence of landings and a paucity of sightings suggest that the flow has subsided.<br />
<br />
<b> MEDITERRANEAN SEA</b> - The European Union wants to stop smugglers near the African coast. European governments are divided over the fates of those who reach shore. In May, European leaders said they would form a naval force based in Italy to combat people-smuggling. The European Commission also appealed to the bloc’s member states to accept quotas of migrants to relieve the burden on southern states, like Italy and Greece, which are the main landing points. Poverty and war in places like Libya, South Sudan, Eritrea and Nigeria are driving migrants to make the perilous journey across the Mediterranean Sea.<br />
<b><br />
EASTERN EUROPE</b> - Fighting between Ukrainian troops and pro-Russian separatists has severely damaged Ukraine’s industrial belt. Hundreds of thousands of Ukrainians have fled to Russia. But European Union countries, like Poland, Germany and Italy, which are among the top destinations for asylum seekers, have rejected most applications from Ukrainians. Less than a third of the $316 million needed in 2015 for the United Nations’ humanitarian response has been raised so far. The conflict was particularly damaging to Ukraine’s economy, which is expected to shrink 9 percent by the end of the year.<br />

Nepal on Sunday was left reeling in shock a day after a 7.8 magnitude earthquake caused widespread destruction across the Himalayan nation and claimed over 3,617 thus far. More than 6,500 people have been injured, according to the National Emergency Operation Centre. Several climbers were killed when the earthquake caused a massive avalanche around Mount Everest. More than 200 climbers have been rescued. </span></span><br />
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;"><br /></span></span>
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">The earthquake reduced whole neighborhoods to rubble and sent deadly tremors throughout the region, including in Pakistan, India, Tibet and Bangladesh. Rescuers were unable to reach remote Nepali villages near the quake's epicenter, and aid agencies warned the full extent of death and destruction was just beginning to emerge. As strong aftershocks shook Nepal for a second day, the country's hospitals were overflowing with the dead and wounded. Search teams continued to scour the wreckage for survivors, and hundreds of victims were laid to rest in traditional cremation ceremonies. Grieving relatives flooded the famed Hindu Pashupatinath Temple on the outskirts of the capital Kathmandu to take part in mass funerals. <br />

As we celebrate our shared planet this Earth Day, we think of the millions who live in countries with limited or no legal defenses to stop their lands and environment from being threatened or damaged by resource exploitation—and consider how lawyers are uniquely positioned to help. </span></span><br />
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;"><br /></span></span>
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">Around the world, communities are being displaced and denied access to their lands and natural resources on an industrial scale. Consider the villagers of Koh Kong province, Cambodia, where thousands of people have been—and continue to be—forcibly displaced from their ancestral lands to make way for large-scale industrial sugar plantations. Villagers protested, sent formal complaints, and attempted to negotiate with company and government officials, all without success. Two local NGOs contacted the International Senior Lawyers Project (ISLP), whose volunteer lawyers helped them formulate a transnational legal strategy to move their case beyond the jurisdiction of Cambodia’s corrupt and ineffective judicial system. </span></span><br />
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;"><br /></span></span>
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">But these types of injustices are not inevitable. In Kenya’s Kerio Valley, ISLP has assembled a team of legal experts to help residents achieve positive impacts and benefits from anticipated oil exploration and development on their lands. The team is working closely with local advocates and community representatives to inform them of their rights, gauge expectations, impart valuable negotiation skills, and formulate strategies for continuing engagement with the oil company. These and similar efforts demonstrate that communities, with the right legal support, can make their voices heard. </span></span><br />

LRJ will help communities prevent or remedy damage from large-scale resource development projects by empowering vulnerable communities to use the law to protect their interests and to amplify their voices internationally. </span></span><br />

Through this approach, we intend to highlight the economic and social value generated when communities gain a seat at the table with governments and corporate interests. <span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">On a rainy night five years ago, Officer Coleman “Duke” Brackney set off in pursuit of a suspected drunk driver, chasing his black Mazda Miata down rural Arkansas roads at speeds of nearly 100 miles per hour. When the sports car finally came to rest in a ditch, Brackney opened fire at the rear window and repeatedly struck the driver, 41-year-old James Ahern, in the back. The gunshots killed Ahern.<br />
<br />
Prosecutors charged Brackney with felony manslaughter. But he eventually entered a plea to a lesser charge and could ultimately be left with no criminal record.<br />
<br />
Now, he serves as the <a href="http://www.scrippsmedia.com/kmtv/news/200650981.html" target="_blank">police chief </a>in a small community 20 miles from the scene of the shooting.<br />
<br />
Brackney is among 54 officers charged over the past decade for fatally shooting someone while on duty, according to an analysis by The Washington Post and researchers at Bowling Green State University. </span></span><br />
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;"><br /></span></span>
<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">This analysis, based on a wide range of public records and interviews with law enforcement, judicial and other legal experts, sought to identify for the first time every officer who faced charges for such shootings since 2005. These represent a small fraction of the thousands of fatal police shootings that have occurred across the country in that time.<br />
<br />
In an overwhelming majority of the cases where an officer was charged, the person killed was unarmed. But it usually took more than that.<br />
<br />
When prosecutors pressed charges, The Post analysis found, there were typically other factors that made the case exceptional, including: a victim shot in the back, a video recording of the incident, incriminating testimony from other officers or allegations of a coverup.<br />
<br />
Forty-three cases involved at least one of these four factors. Nineteen cases involved at least two.<br />
<br />
In the most recent incident, officials in North Charleston, S.C., filed a murder charge Tuesday against a white police officer, Michael T. Slager, for gunning down an apparently unarmed black man. A <a href="http://www.washingtonpost.com/posttv/national/south-carolina-police-officer-shoots-man-after-traffic-stop/2015/04/07/1e0ece0c-dd7b-11e4-b6d7-b9bc8acf16f7_video.html" target="_blank">video recording</a> showed Slager repeatedly shooting the man in the back as he was running away.<br />

<span style="color: black; font-family: georgia, serif;"><span style="font-size: medium;">One by one, four former Blackwater security contractors wearing blue jumpsuits and leg irons stood before a federal judge on Monday and spoke publicly for the first time since a deadly 2007 shooting in Iraq.<br />

The men had been among several private American security guards who fired into Baghdad’s crowded Nisour Square on Sept. 16, 2007, and last October they were convicted of killing 14 unarmed Iraqis in what prosecutors called a wartime atrocity. Yet on Monday, as they awaited sentences that they knew would send them to prison for most if not all of their lives, they defiantly asserted their innocence.<br />
<br />
The judge, Royce C. Lamberth, strongly disagreed, sentencing Mr. Slatten to life in prison and handing 30-year sentences to the three others. A fifth former guard, Jeremy P. Ridgeway of California, had pleaded guilty to voluntary manslaughter and testified against his former colleagues. He has not been sentenced but testified that he hoped to avoid any prison time.<br />
<br />
The ruling ended a long investigation into the Nisour Square shooting, a signature, gruesome moment in the Iraq war that highlighted America’s reliance on private contractors to maintain security in combat zones.<br />
<br />
No such company was more powerful than Blackwater, which won more than $1 billion in government contracts. Its employees, most of them military veterans, protected American diplomats overseas and became enmeshed in the Central Intelligence Agency’s clandestine counterterrorism operations. Its founder, Erik Prince, was a major donor to the Republican Party.<br />
<br />
In Iraq, Blackwater was perceived as so powerful that its employees could kill anyone and get away with it, said Mohammed Hafedh Abdulrazzaq Kinani, whose 9-year-old son, Ali, was killed in Nisour Square.<br />
<br />
“Blackwater had power like Saddam Hussein,” Mr. Kinani said in a long, emotional appeal to the judge on Monday. “The power comes from the United States.” He added later: “Today we see who will win. The law? Or Blackwater?”<br />
